FMLA Leave Designation Packets for HR Operations
An FMLA leave designation agent should assemble eligibility, certification, and clock facts into a review record. It should not designate leave, deny protection, or close a medical file on its own.
Direct Answer
The agent builds the leave file. A named administrator designates.
FMLA leave designation agents help HR operations, leave administrators, and benefits teams finish eligibility, certification, and designation work without hiding the legal notice. The agent should read the leave request, the hours and tenure record, any medical certification, and the leave-year balance, name every gap against the Wage and Hour clocks, and route a packet to the person who will send WH-381 or WH-382. It should not designate leave as FMLA-protected, deny protection, contact a health care provider, or assess attendance points.
The work looks like time-off administration until a five-business-day eligibility notice is late, a certification sits incomplete past the cure window, or a manager writes someone up for an absence that should have been designated. The Department of Labor's March 2025 Fact Sheet 28D tells covered employers to give an eligibility notice within five business days of the request or of learning that the leave may qualify, and to give a written designation notice within five business days once they have enough information to decide. Those clocks do not pause because the manager emailed HR late or the leave system ticket is still open.
Our bias is to treat FMLA work as a dated review record with one accountable leave administrator, not as a chat thread about time off. The systems already exist: hours and worksite counts in the HRIS or time system, the leave request in the absence tool, optional Form WH-380-E or WH-380-F from the employee, paid-leave balances in payroll, and a medical file that must stay out of the ordinary personnel folder.
Old Pattern
Most FMLA programs are a manager email, a shared inbox, and a late notice.
The common pattern is quiet until a complaint or a return-to-work fight. An employee texts that they are in the hospital. A supervisor forwards the message three days later. Someone asks for a doctor's note in the same thread that other employees can see. A coordinator later prints WH-381 after the person has already been out a week. When counsel asks whether eligibility and designation went out on time, the team reconstructs the file from chat, calendar, and a spreadsheet of remaining weeks.
A sick-day request is not an eligibility decision
Employees do not have to say the letters FMLA. Fact Sheet 28 says they must give enough information that the employer can see the leave may qualify. A hospital admission, planned surgery, or a parent in hospice is already a clock, even when the ticket type is PTO.
A doctor's note is not a complete certification
If the employer requires certification, Fact Sheet 28G says the employee generally has 15 calendar days, and that an incomplete form is missing entries while an insufficient form is vague or non-responsive. A one-line excuse slip does not start designation by itself.
A closed time-off ticket is not a designation file
Ticket completion does not prove the eligibility notice, the written rights-and-responsibilities content, the amount of leave counted, the fitness-for-duty warning, or that group health coverage stayed on the same terms.
Clocks And Form Facts
Four clocks decide the packet. The leave year is one of them.
Wage and Hour last revised Fact Sheet 28 in March 2025. Eligible employees of covered employers may take up to 12 workweeks of job-protected leave in a 12-month period for most FMLA reasons, and up to 26 workweeks of military caregiver leave in a single 12-month period. Eligibility is 12 months with the employer, 1,250 hours of service in the 12 months before leave starts, and a worksite with at least 50 employees within 75 miles. Private-sector coverage is 50 or more employees in 20 or more workweeks in the current or prior calendar year. Public agencies and local educational agencies are covered without that headcount test.
The remaining clocks are operational. The eligibility notice is due within five business days of the request or of the employer learning the leave may qualify, and it must state eligibility or at least one reason the employee is not eligible. The written rights-and-responsibilities notice travels with that eligibility notice and must name the leave year the employer uses, any certification demand, paid-leave substitution rules, key-employee status if it applies, job restoration, and health-premium arrangements. Designation is due in writing within five business days after the employer has enough information to decide, including whether paid leave will be substituted, whether a fitness-for-duty certification will be required, and how much leave will count if that amount is known. If the amount is not known, the employer must put it in writing when the employee asks, but no more often than once in a 30-day period and only if leave is taken in that period.
Certification has its own pair of clocks. When the employer requires medical certification for a serious health condition, it should ask at notice or within five business days, and the employee generally has 15 calendar days. Bonding leave for a newborn or a newly placed child does not take a medical certification; the employer may ask only for documentation of the family relationship. If a submitted certification is incomplete or insufficient, the employer must say in writing what is missing and give seven calendar days in most cases to cure it. DOL's optional notice and certification forms remain usable after their OMB expiration dates. Do not mail completed forms to the Wage and Hour Division.
Review Record
Give every leave event six fields the administrator can send from.
The first useful agent version does not own the designation or the medical file. It produces one review record per employee per qualifying reason, in the language the leave administrator already uses, and keeps it short enough to finish before the fifth business day.
Event and clock
Name the event as new request, unforeseen start, recertification, incomplete-certification cure, second or third opinion, or return-to-work. Record the date the employee gave notice or the date the employer first had reason to know the leave might qualify, the eligibility-notice due date, the designation due date once facts are enough, and, when certification is required, the 15-calendar-day employee clock and any seven-calendar-day cure clock.
Eligibility facts as stored
Capture months of service, hours actually worked in the prior 12 months, and the 50-employee, 75-mile worksite count from the HRIS or time system. Note the employer's leave-year method as already published to employees. Do not invent hours from a salaried schedule. A missing hours extract is a gap, not a guess.
Qualifying reason and schedule
Record the reason in the employee's words and the schedule as continuous, intermittent, or reduced. Fact Sheet 28 allows intermittent or reduced-schedule leave when medically necessary, and for military family leave. Bonding leave on an intermittent or reduced schedule needs agreement from both the employee and the employer. Do not restate a diagnosis in the packet that managers will see.
Certification status
Note whether certification is required, which optional form or equivalent the employee used (WH-380-E, WH-380-F, WH-384, WH-385, or WH-385-V), whether the file is complete and sufficient, and the exact missing entries if it is not. Flag a bonding request as no-medical-certification. Record any second-opinion or recertification clock without drafting a medical opinion.
Recommended disposition
Propose send eligibility notice, send combined WH-381, request certification, write a seven-day cure, designate as FMLA, designate as not FMLA, wait for a second opinion, open a recertification, or issue a fitness-for-duty reminder. State the short rule that produced the recommendation. A recommendation is not a designation.
Owner, next write, and medical-file lane
Name the leave administrator who will send the notice. Name the next human write, such as issuing WH-381, WH-382, a simple written non-designation, or a return-to-work note. Keep medical certifications on the confidential medical-file path Fact Sheet 28G requires, separate from the usual personnel file.
Example
A Friday hospital text is already a Monday eligibility clock.
Consider a 220-person services firm with sites in two states and a rolling leave year. A technician texts a supervisor Friday night that they were admitted after a fall. The supervisor forwards the text Monday at 10 a.m. The agent should start the eligibility clock from Friday night if that is when the company first had the facts, pull months and hours from the time system, and draft a WH-381 for the leave administrator to send before the fifth business day. It should not wait for the employee to type the word FMLA, and it should not post the hospital detail to the team channel.
The same week, a separate employee returns WH-380-E with the treatment dates blank. Fact Sheet 28G treats that as incomplete. The packet should name the missing entry, start a seven-calendar-day cure, and keep the leave provisionally in review. The agent drafts the written deficiency note. A named administrator sends it. The coordinator should not deny the entire leave on the first incomplete page.
A third line is already designated for an employee's own serious health condition and starts taking two-hour therapy blocks that the certification did not estimate. Recertification is the next packet, not an attendance write-up. Fact Sheet 28G generally limits recertification to every 30 days and only with an absence, allows a request every six months even when the condition looks indefinite, and still gives the employee at least 15 calendar days. The agent attaches the absence pattern for the administrator. It does not let a supervisor call the clinic. Fact Sheet 28G says the employee's direct supervisor may never contact the health care provider.
A fourth line is bonding leave after adoption. The packet should say no medical certification, ask only for relationship documentation if the company requires it, and note that intermittent bonding leave needs a written agreement. This lane is later than the employee-change work in https://solzero.com/blog/hr-operations-agents-for-employee-changes. Job, manager, and location updates belong there. FMLA work decides whether the absence is designated, timed, and inspectable.
Implementation
Sequence the lane as read, compare, draft, route, then write.
Start with one worksite, one leave system of record, and the last 30 days of absences that mention medical treatment, family care, bonding, or military family leave. Do not begin with every historical leave, every state paid-leave overlay, and a full file audit at once.
Read the request and the service record
Pull the notice date from email, chat, or the absence tool, not from the first day someone remembered to open a ticket. Read months of service, hours actually worked, and the 50-within-75 count from the system of record. Freeze that version with the review.
Compare against the clocks and the notices
Test on-time eligibility notice, written rights-and-responsibilities content, whether certification was requested inside five business days, whether a complete certification exists, and whether designation is due. For open leaves, test recertification timing and any fitness-for-duty warning that should have been in the designation.
Draft the packet, not the designation
Write the review record and any WH-381, WH-382, cure letter, or simple non-designation statement in the team's existing format. Draft only. Sending the notice and counting the weeks stay human actions in the first version.
Route to the leave administrator
Send the packet to the person who will issue the notice and maintain the medical file. The approval-packet pattern at https://solzero.com/blog/approval-packets-for-human-in-the-loop-agents is the review surface; the FMLA rule itself stays on the Wage and Hour notices and 29 CFR part 825.
Write through a controlled step
Post designated hours to the leave ledger, start or stop paid-leave substitution, or issue a fitness-for-duty reminder only after a named owner approves that write. The permission inventory in https://solzero.com/blog/tool-permission-inventory-before-agent-launch is the right gate for those tools.
Controls
Keep designation, medical contact, and attendance discipline with named people.
FMLA work is an employer notice duty dressed up as time-off tracking. The agent should make the file complete and keep the judgment where the regulations put it.
No silent designation or silent denial
Fact Sheet 28D says failure to provide required notices may constitute interference with FMLA rights. The agent can recommend designate or not designate. A named administrator still has to send the written notice, including a simple written statement when the leave is not FMLA-protected.
No supervisor-to-clinic calls
Authentication and clarification, when allowed, go through a human-resources professional, leave administrator, management official, or another health care provider. The employee's direct supervisor stays out of that contact. Second and third opinions are employer-paid, and the employee is provisionally entitled to FMLA leave while those opinions are pending.
No attendance points on designated leave
Fact Sheet 28 treats write-ups, negative attendance points, denied bonuses the employee had already earned, and equivalent-job failures as possible FMLA violations. The agent should flag a discipline draft that cites an absence already in an FMLA packet. It should not post the point.
No extra medical questions
Employers who use their own certification forms may not demand information beyond the FMLA regulations. Genetic information stays out. A diagnosis is optional for the provider. Bonding leave does not get a medical form.
Medical-file confidentiality
Certifications, recertifications, and fitness-for-duty notes stay in confidential medical files, separate from ordinary personnel files, and aligned with ADA and GINA confidentiality where those laws apply. The review record that managers see should carry clocks and dispositions, not clinical detail.
State paid-leave overlays stay named, not flattened
Fact Sheets 28 and 28D both say state family and medical leave laws can add protections and that workers keep the benefit of every law that applies. The packet should name a state paid-leave claim when one exists. It should not treat a state payment as proof that federal designation happened, or skip federal notices because a state program already paid the week.
Scoreboard
Measure on-time notices, not leave tickets closed.
An FMLA agent is working when administrators decide from the record and when late or missing notices are visible before the fifth business day. Useful measures include the share of possible-qualifying absences with an eligibility notice sent on time, designations sent within five business days of a complete file, certifications requested inside five business days, incomplete files that received a written seven-day cure instead of a silent denial, recertifications requested inside the 30-day or six-month rules, and the minutes needed to export one employee's notice-and-certification set.
Watch administrator edits to the recommended disposition as well. Frequent moves from designate to request certification mean the completeness rules are too loose. A growing late-but-undesignated queue means the packet is arriving after the person who can send WH-382 has already left for the day.
The SolZero take is that FMLA leave designation is a good early HR-operations agent because the inputs are dated, the notice rules are public, and the decision boundary is easy to name. The agent should make every possible-qualifying absence cheaper to review and harder to leave undesignated. Hire-file clocks are a cousin, not a substitute: I-9 work at https://solzero.com/blog/i-9-employment-eligibility-packets-for-hr-ops decides whether the person who started has an inspectable verification file. This packet decides whether the absence is protected and timed. If a site already has late eligibility notices and nobody owns the medical-file calendar, the operating sequence is at https://solzero.com/#how-it-works.
FAQ
Two questions leave administrators ask before the first lane.
Can the agent send WH-382 when the certification looks complete?
No. Completeness is not designation. Fact Sheet 28D requires the employer to give a written designation notice once it has enough information to decide. An agent can prepare WH-382 and attach the certification. A named administrator still has to decide and send it.
Does using paid sick leave mean the team can skip FMLA notices?
No. Fact Sheet 28 says FMLA leave may be unpaid or used at the same time as employer-provided paid leave, and that an employer may require substitution. Paying the week does not replace the eligibility notice, the rights-and-responsibilities notice, or designation.
